  1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the website https://www.thegizmostore.co.ke/terms-conditions/ (the “Site”) and all purchases of goods and services from The Gizmo Store (“we,” “us,” “our”). Please read these Terms carefully. By accessing our Site or placing an order, you agree to be bound by these Terms, our Privacy Policy, and our Returns & Refunds Policy. If you disagree with any part, please do not use our Site or services.

  1. Orders & Acceptance

2.1. Placing an Order. You can place an order through our Site, by phone, WhatsApp, or email using the contact details provided on our Site.
2.2. Order Confirmation. An order is not accepted until we send you a written Order Confirmation (e.g., via email). This confirmation will detail the final specifications, quantities, price, and delivery terms. A contract between us is formed only upon our Order Confirmation.

  1. Pricing & Payment

3.1. Prices. All prices are in Kenyan Shillings (KES) and are exclusive of VAT, delivery, and installation fees unless stated otherwise.
3.2. Price Changes. 
We reserve the right to adjust prices. However, the price confirmed in your Order Confirmation is final for that order.
3.3. Quotations. 
Any quotation we provide is valid for 30 days from the issue date, unless we state otherwise in writing.
3.4. Payment.

  • Standard Orders: Full payment is required before dispatch or collection of goods.
  • Approved Credit Accounts: Invoices must be settled within the agreed credit period. Late payments may incur interest and/or lead to suspension of credit facilities.
  • Payment Methods: Payment must be made via our approved methods. You must provide proof of payment to facilitate order processing.
    3.5. Payment Security. 
    All payments are processed through secure, encrypted payment gateways. We comply with applicable data protection laws and do not store full payment card details on our servers.
  1. Delivery

4.1. Delivery Areas. We deliver across Kenya and to major cities in East Africa. Specific delivery timelines will be confirmed in your Order Confirmation and are subject to stock availability and logistics.
4.2. Delivery Fees. Any applicable delivery fees will be clearly communicated and agreed upon before dispatch.
4.3. Transfer of Risk. Ownership and risk of loss or damage to the goods pass to you upon delivery to the address you provided. We are not liable for delays caused by events beyond our reasonable control (e.g., supplier delays, transport disruptions, weather).

  1. Returns, Exchanges & Refunds

Our Returns and Refunds Policy is incorporated into these Terms. The summary below is for convenience, but the full policy on our website prevails.

5.1. Return Eligibility. You may return goods for the following reasons:

  • The product is defective, damaged, or dead on arrival.
  • You received an incorrect item.
  • You have changed your mind (buyer’s remorse). The item must be unused and in its original packaging.

5.2. Return Window. You have 30 days from the date of delivery to initiate a return.

5.3. Process. To initiate a return, you must contact us to request a Return Merchandise Authorization (RMA) number. Returned goods must be unused, in their original packaging with all accessories and manuals.

5.4. Restocking Fee. A restocking fee of 15% applies to all returns for change of mind (non-defective items) to cover the costs of inspection, repackaging, and restocking. No restocking fee is applied to returns for defective or incorrect items.

5.5. Refunds. Approved refunds will be processed to the original payment method within 5 business days from the date of return approval.

5.6. Non-Returnable Items. The following are final sale and cannot be returned unless defective or incorrect: customized or specially configured products, software with broken seals, and items marked “Clearance” or “Final Sale.”

  1. Order Cancellations

6.1. Standard Orders. You may cancel a standard order at no charge only if you notify us before the order has been dispatched for delivery or made available for collection.
6.2. Dispatched & Custom Orders. 
Orders that have been dispatched or are custom/special orders cannot be cancelled once processing has commenced.
6.3. Consumer Rights. 
Your statutory rights of cancellation under Kenyan consumer law are not affected by this clause.

  1. Product Availability

If a product is unavailable, we will notify you promptly. We may offer a suitable alternative (subject to your approval) or provide an updated delivery schedule. We reserve the right to partially fulfill orders.

  1. Warranties

Goods supplied by us are covered by the manufacturer’s warranty, where applicable. To make a warranty claim, the goods must have been used according to the manufacturer’s guidelines and show no signs of tampering, misuse, or physical damage. We provide no warranty beyond the manufacturer’s, unless we expressly agree otherwise in writing.

  1. Limitation of Liability

To the fullest extent permitted by law:

  • Our total liability to you for any claim arising from these Terms or your order shall not exceed the total value of the goods in the specific order giving rise to the claim.
  • We shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities.
  1. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Nairobi, Kenya.
